End User Licence Agreement

This agreement is between you and SS Enterprises and covers the SmoothCut application for macOS and Windows. Installing or using the app means you accept it.

1. 1. What you get

   We grant you a personal, non-exclusive, non-transferable licence to install and use SmoothCut:

   • Without a licence key: to record, edit and preview, on any number of computers.
   • With a Personal key: additionally to export, on one computer at a time, including updates released within one year of purchase.
   • With a Pro key: additionally to export, on up to five computers at a time, including every update we release.

   "At a time" means you can move a key between computers by deactivating one from the app or from your account. The count of active computers may not exceed the licence.

2. 2. What you may not do

   • Share, sell, rent or sublicense a licence key, or publish it.
   • Work around the seat limit, the licence check, or any technical protection.
   • Reverse engineer, decompile or modify the app, except where the law expressly allows it.
   • Use the app to record other people where you do not have the right to.

3. 3. Your recordings

   Everything you record and export with SmoothCut is yours. Recording, editing, captions and export run on your computer, and we do not receive your recordings. You are responsible for what you record and where you publish it.

4. 4. The licence check

   Activating a key sends the key and a one-way hash of a hardware identifier to our server, which returns a signed token stored on your computer. The app verifies that token locally and checks in with the server periodically when online. The raw hardware identifier never leaves your computer. Details are in the Privacy Policy.

5. 5. Updates

   The app checks for updates and downloads them; it installs one only when you agree or when you next quit. A Personal licence receives releases published within one year of purchase; releases after that are not offered to it, and the app keeps working as it is. A Pro licence receives every release.

6. 6. Termination

   The licence ends if you breach this agreement, or if the payment for it is refunded or reversed. On termination the export feature stops working; you may keep using the app for recording and editing, and you keep every file you exported.

7. 7. Warranty

   We provide the app with reasonable care and fix reported bugs as we can, but it is provided "as is". We do not promise it will be free of errors or fit for a particular purpose. Where the law implies a warranty that cannot be excluded, its duration is limited to 14 days from purchase.

8. 8. Liability

   To the extent the law allows, our liability to you under this agreement is limited to the price you paid for the licence. We are not liable for lost recordings, lost profits or indirect losses. Nothing here limits liability for death, personal injury, fraud, or anything else that cannot be limited by law.

9. 9. Third-party software

   The app includes open-source components under their own licences. The notices are in the app's third-party notices file.

10. 10. Governing law

    This agreement is governed by the laws of India, with disputes subject to the courts of Chandigarh, India, without prejudice to any consumer rights you have where you live.
